These Terms of Service ("Terms") govern your use of the Blackbone Messenger app for iOS, macOS and web ("the Service"), operated by Blackbone SRL, a company registered in Romania ("Blackbone", "we", "us"). By creating an account or using the Service, you confirm that you have read, understood and accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. The Service
Blackbone Messenger lets you send text messages, images, files and voice messages, make audio and video calls, and use groups, channels, stories and bots. We may modify, update or discontinue the Service, in whole or in part, at any time.
2. Eligibility
You must be at least 16 years old (or the minimum legal age in your jurisdiction). By using the Service you represent that you meet this requirement and have the legal capacity to enter into these Terms.
3. Your account
You are responsible for keeping your credentials confidential and for all activity under your account. You must provide accurate information and must not impersonate any person or entity. Two-factor authentication is available and recommended.
4. Acceptable use
You agree not to use the Service to:
- send content that is illegal, defamatory, threatening, harassing, obscene, or that incites hatred, violence or discrimination;
- infringe intellectual property or privacy rights;
- send spam, fraud, malware or otherwise abuse the Service;
- exploit or endanger minors;
- gain unauthorized access to, or disrupt, our systems;
- use the Service for any unlawful purpose.
There is zero tolerance for objectionable content and abusive users. You can report content and block users in the App; reports are reviewed and we may act on them (see Section 6).
5. Your content
You retain your rights to the content you send and are solely responsible for it. You grant us a strictly technical license to store and transmit it only to operate the Service. We do not claim ownership of your content and do not sell it. For end-to-end encrypted direct chats, we hold only ciphertext.
6. Moderation, reporting and suspension
You can report abusive content or users and block users directly in the App. We may remove reported content and suspend or terminate accounts that violate these Terms or the law, with or without prior notice. We aim to act on valid reports of objectionable content promptly.
7. Privacy and encryption
Direct one-to-one conversations and their files may be end-to-end encrypted, in which case their content cannot be read by Blackbone. Details are in our Privacy Policy.
8. Intellectual property
The Service, together with the Blackbone trademarks, logos and software, belongs to Blackbone SRL and is protected by law. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices you own or control, in accordance with the App Store Terms of Service.
9. Apple App Store (EULA terms)
If you obtain the App via the Apple App Store, you acknowledge that these Terms are between you and Blackbone only, not Apple, and that Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event the App fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, or consumer protection claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.
10. Disclaimer and limitation of liability
The Service is provided "as is", without warranties of any kind. To the maximum extent permitted by law, Blackbone SRL is not liable for indirect damages, data loss, lost profits or interruptions. We do not guarantee uninterrupted or error-free delivery of messages and calls.
11. Indemnification
You will indemnify Blackbone SRL against any claim arising from your breach of these Terms or of the law.
12. Changes
We may update these Terms. Continued use of the Service means you accept the updated Terms.
13. Governing law
These Terms are governed by Romanian law. Disputes are resolved by the competent courts of Romania, subject to any mandatory consumer-protection rights you may have.
